Edit: I am not a Maliki nor very well acquainted with the madhhab so I will resist what you cite for now, however what I said above is the position of my sheikh and Ill investigate further into the issue but a quick search revealed it seems there is dissent among Malikis themselves on this matter, if you wish Ill reply later
